Introduction
These Terms & Conditions (this ‘Agreement’) is a legal agreement between (‘you’) and Babyluv Care OÜ, a company incorporated in Estonia (‘Company’, ‘we' or ‘us) for the use of the CARÁ mobile application (‘App’), the website carahealth.io, and all related services, featured and content offered by the company. This Agreement is not concluded with Apple, INC, and of its subsidiaries, Google, Inc., and of its subsidiaries, or any other entity as may apply.
1. Acceptance of Terms
Please read these terms attentively. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use CARÁ.
2. Terms and Conditions for participating
In order to utilize CARÁ Services and establish a user account, it is a prerequisite that you possess the full legal capacity and have attained the minimum age of 18 years. It is important to note that CARÁ Services are solely intended for consumer use. A consumer, as defined by law, is a natural person who engages in legal transactions for purposes that are not primarily related to their commercial or self-employed activities. The use of CARÁ Services for any commercial purposes is strictly prohibited.
3. Accessing our website
We reserve the right to modify or terminate any services provided on our website without prior notification. We reserve the right to restrict access to some or all areas of our website on an intermittent basis. We shall not be held liable in any event or circumstance for the unavailability of our website during any period. Your right to use our website is terminated immediately in the event that you breach any of these General Terms and Conditions of Business. You are required to immediately destroy any printed or downloaded extracts obtained from our website.
By accessing our website, any individual using your computer agrees to be bound by the General Terms and Conditions of Business. As the user, you are responsible for ensuring that all individuals who access our website through your internet connection and on your computer are aware of these General Terms and Conditions of Business and that they adhere to them. 4. Support and Updates
CARÁ is not obligated to provide support or maintenance for the service under the terms of this agreement. However, CARÁ may, at its sole discretion, offer limited technical support for the service. You acknowledge that the service is a continuously evolving product. While your license for the service remains valid, you are entitled to receive any upgrades or updates to the service. Any upgrades or updates provided to you shall be subject to the terms of a license exchange. By utilizing any upgrade or update, you agree to terminate your right to use any prior version of the service. CARÁ may issue licenses for upgrades or updates to you with additional or alternative terms. In order to utilize the service, you may be required to update third-party software and/or upgrade your equipment from time to time.

The use of CARÁ is at your own risk. CARÁ is designed to provide general educational information and resources related to pregnancy and childbirth. The information provided in CARÁ is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Registration via mobile apps:
The formation of the user contract when registering via mobile apps is subject to the rules and regulations of the app store supplier, such as Apple, Google, Sony, etc. Generally, the contract is formed upon clicking on the "Install" button in the appropriate app store and, if necessary, entering the required password. It is important to note that the creation of a free user account with CARÁ is still required to access and utilize CARÁ services.
9. User Content
You are solely responsible for any content that you post or transmit through CARÁ, including comments, reviews, or other information (collectively, "User Content"). By posting or sharing User Content, you grant CARÁ a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, display, reproduce, modify, create derivative works, and distribute such User Content in connection with CARÁ. You represent and warrant that you have all necessary rights to post or transmit User Content and that the User Content does not infringe on the intellectual property rights of any third party or violate any applicable laws or regulations.

CARÀ and its contents, including but not limited to text, graphics, images, and software, are the property of CARÁ or its licensors and are protected by copyright, trademark, and other intellectual property laws. 11. Payment Terms
If CARÁ involves payments, you agree to pay all fees and charges associated with your use of CARÀ. You authorize CARÁ to charge your payment method for all fees and charges.
12. User Conduct
You agree to use CARÁ only for lawful purposes and in compliance with these Terms. You may not use CARÁ to engage in any activity that violates any law or infringes on the rights of CARÁ or any third party.
13. Limitations of Liability
CARÁ shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use CARÁ.
14. Validity
The user contract concluded between you and us once you register your account is valid for an indefinite period.
15. Governing Law and Jurisdiction
These Terms and your use of CARÀ shall be governed by and construed in accordance with the laws of Estonia. Any disputes arising from or in connection with these Terms or CARÁ shall be resolved by the Harju District Court in Estonia.
